Comparative Analysis of Gender Assumptions in the American and Australian Family Courts

Abstract:

The family court systems in the United States and Australia are broken. It is hypocritical to assert that the court system acts in the best interests of the child. A comparative analysis of the American and Australian systems will reveal the gender assumption corruption that the courts hold and predicate their decisions on. From the start, men had absolute sole custody since women were more subservient, but as time passed and society changed, these rulings began to change too. Now in today’s society, a mother’s right to custody far exceeds the father’s right even when evidence shows it is not in the best interest of the child. To combat the corrupt and broken system, the entire system needs to be reevaluated and fixed. The paper and presentation will conquer some of these solutions and will discuss how viable each option is.
